IMPORTANT NOTICE: PLEASE REVIEW THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING OUR SERVICES, AS THEY FORM A LEGALLY BINDING AGREEMENT BETWEEN YOU AND CONTROL PLUS LLC.
Control Plus LLC is a corporation organized under the laws of the State of Delaware, United States of America (“Company,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your use of and access to our services, which include identity protection, secure browsing, SMS and call filtering, data removal, and family account features. The Services are made available through our website at https://controlplus.app/, our mobile application, and any other platforms or methods we may offer (collectively, the “Services”).
By accessing, connecting to, or otherwise using the Services, you confirm that you have read and understood these Terms and our Privacy Policy, and that you agree to be legally bound by them.
MANDATORY ARBITRATION NOTICE: THESE TERMS REQUIRE THAT MOST DISPUTES BETWEEN YOU AND CONTROL PLUS OR ITS AFFILIATES BE RESOLVED THROUGH BINDING ARBITRATION ON AN INDIVIDUAL BASIS. THIS MEANS YOU AGREE TO WAIVE THE RIGHT TO A TRIAL BY JUDGE OR JURY, AND YOU WILL NOT PARTICIPATE IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST REFRAIN FROM ACCESSING, CONNECTING TO, OR USING THE SERVICES IN ANY WAY.
ELIGIBILITY
2.1. Use of the Services is limited to individuals who meet our eligibility criteria, have created a valid user account, and have enrolled in an active subscription plan. Certain Services may also require you to download and install designated software on a compatible device before access is granted.
2.2. For the purposes of these Terms, “Eligible” refers to individuals who reside in the U.S., Canada, the United Kingdom, and Australia and who are either eighteen (18) years of age or older, or have reached the legal age of majority in their place of residence, whichever is greater.
2.3. By registering for, accessing, or using the Services, you affirm and warrant that you meet the eligibility requirements described in this section. The Services are not offered to persons who do not meet these criteria, nor to any user whose access has previously been suspended, terminated, or revoked.
2.4. You must also possess the legal capacity to enter into a binding agreement. You are responsible for safeguarding your account credentials and for all actions taken through your account. If you suspect any unauthorized use or access, you must notify us promptly.
SERVICES
3.1. We provide tools to assist you in managing your digital privacy. These tools include, but are not limited to: Identity Protection (e.g. monitoring known dark web sources for leaks involving your email address, telephone number, and related personal information); Browsing Security (e.g. scanning web traffic at the Domain Name System level and categorizing websites to help you avoid fraudulent or harmful content); Short Message Service (SMS) Protection (e.g. filtering harmful or unwanted messages into a junk folder); Call Protection (e.g. enabling you to view and manage blocked numbers); Data Removal (e.g. automating opt-out requests to third-party data brokers using personal information that you provide); and Family Protection (e.g. allowing you to invite up to five individuals to participate under your account).
3.2. You agree not to engage in any of the following:
3.2.1. Use the Services if you are not an Eligible User;
3.2.2. Use the Services for unlawful, abusive, or illegal purposes in violation of applicable laws at the local, state, provincial, territorial, national, or international level;
3.2.3. Misrepresent your identity or your authority to use another person’s personal information;
3.2.4. Remove, bypass, disable, damage, or otherwise interfere with any security-related features of the Services, including features that prevent or restrict the use or copying of software or that enforce limitations on usage;
3.2.5. Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Services or any portion thereof;
3.2.6. Access or use the Services to develop, train, benchmark, or enhance any product or service that competes with, replicates, or mimics any functionality of the Services; conduct any product, feature, or market analysis without the Company’s prior written consent; or engage in any activity intended to gain a competitive advantage over the Company;
3.2.7. Intentionally interfere with or damage the operation of the Services by any means, including uploading or disseminating malicious code such as viruses, adware, spyware, or worms;
3.2.8. Tamper with, modify, or otherwise interfere with the Services;
3.2.9. Share your access credentials with any person who is not authorized under your subscription; or
3.2.10. Use the Services for commercial purposes, as they are intended for personal, non-commercial use only.
3.3. The Services are provided on an “as is” and “as available” basis. We do not warrant that all breaches or threats will be detected, that blocking or filtering will always be accurate, or that the Services will operate without interruption or error.
3.4. Any testimonials, user stories, or performance descriptions appearing in our marketing materials, on our website, or through other communications are provided solely for illustrative purposes. They do not constitute a guarantee, warranty, or assurance of your individual results.
3.5. The Services do not constitute legal, financial, or cybersecurity advice, and nothing in these Terms or in the Services shall be interpreted as creating a fiduciary or advisory relationship. All guidance, notifications, or recommendations generated by the Services are based on automated system logic and available data, and are not individualized human advice. You remain solely responsible for any decisions made based on such information
3.6. You acknowledge that you have not relied, and will not rely, on any statements, representations, warranties, or other communications outside of these Terms. This includes, without limitation, marketing materials, testimonials, service descriptions, or informal communications.
3.7. The Services are not an insurance product and do not provide any guarantee, warranty, or assurance of financial reimbursement, compensation, or recovery of losses. You are solely responsible for obtaining any personal, cyber, or identity theft insurance needed to address risks beyond the scope of the Services.
3.8. You are solely responsible for safeguarding the security and integrity of your devices, networks, account credentials, and personal information. The effectiveness of the Services depends on your timely and complete implementation of any recommended security measures.
3.9. You agree to promptly follow any instructions, recommendations, or required actions issued by the Company through the Services, including via email, in-application notifications, or your account dashboard. Failure to do so may reduce the effectiveness of the Services or result in suspension of your account.
3.10. All Services, features, and functionalities are provided on a beta basis and may contain errors, defects, or technical limitations. We may modify, suspend, or discontinue any feature at any time without prior notice.
SERVICE-SPECIFIC TERMS
These Service-Specific Terms apply only if you have purchased or are using one or more of the particular Services described in this section. If there is any inconsistency or conflict between these Service-Specific Terms and any other terms in this Agreement, the Service-Specific Terms will govern with respect to the applicable Service. In this section, the term “Services” refers to the specific products or features being discussed, along with any related software provided by the Company.
Your subscription may include some or all of the Services described below. It is your responsibility to review these Service-Specific Terms and determine which provisions apply to your subscription. If you are unsure about applicability, you should contact us for clarification.
Any warranty disclaimers or limitations of liability included in these Service-Specific Terms are in addition to, and do not reduce the scope or effect of, any broader warranty disclaimers or liability limitations found elsewhere in these Terms.
**4.1. Dark Web Monitoring.** The Dark Web Monitoring feature (“Dark Web Monitoring Feature”) allows you, as part of the Services, to designate your financial account details, mailing address, and other categories of personal information, subject to the limits set forth in the Services. The Dark Web Monitoring Feature monitors only the information you designate through your account (“Dark Web Monitoring Designated Information”) and will notify you when your Dark Web Monitoring Designated Information is found online. You acknowledge and agree that we cannot remove your Dark Web Monitoring Designated Information from the dark web, that we do not guarantee the accuracy or completeness of any information on the dark web, and that the Dark Web Monitoring Feature will not identify every instance of your Dark Web Monitoring Designated Information appearing there. Any failure to identify such information does not constitute a breach or default of our obligations. By submitting Dark Web Monitoring Designated Information, you confirm that you own the information or have the legal right to provide it to us, and you agree not to use the feature for any purpose other than identity theft protection.
**4.2. Browsing Security**: Our Browsing Security service provides information intended to help users identify certain risks that may be associated with a particular website. We do not control and are not responsible for the content of any third-party websites, and some of those sites may contain material that you may find objectionable, inappropriate, or offensive. THE SITE RATINGS PROVIDED THROUGH THE SERVICES ARE NOT A GUARANTEE OF ANY PARTICULAR SITE’S PRACTICES OR TRUSTWORTHINESS, AND DO NOT REPRESENT AN ENDORSEMENT BY US OF THE SITE’S CONTENT, SUBJECT MATTER, QUALITY, OR USEFULNESS.
**4.3. SMS Protection**:If you subscribe to the SMS Protection service, the feature will allow you, among other capabilities, to filter SMS and MMS messages from senders who are not in your device’s contacts and to block SMS text messages from such senders. It will also attempt to block spam or other unwanted messages.
**4.4. Call Protection**: If you subscribe to the Call Protection service, the feature will allow you, among other capabilities, to block nuisance calls, including robocalls and telemarketing calls.
**4.5. Data Broker Removal**: If you subscribe to the Data Broker Opt-Out Services, you acknowledge and agree to the following:
**4.5.1.** On your behalf, we will make reasonable efforts to have the personal information you provide to us removed or suppressed (“opt-out”), in whole or in part, from certain third-party databases and/or websites operated by the “Data Brokers” identified in the Services. We will only submit opt-outs for the information you provide to us.
**4.5.2.** You expressly authorize the Company, its agents, and its employees to act as your personal representative or authorized agent to submit opt-outs to Data Brokers and to otherwise implement the Services. Where applicable and available to you, this authorization includes acting on behalf of underaged members under the Family Protection Service by obtaining information on your behalf, submitting your personal information to Data Brokers, communicating with Data Brokers or other third parties on your behalf, and taking any other actions we consider reasonably necessary to complete the opt-out process.
**4.5.3.** The scope of the opt-out will vary depending on each Data Broker and its policies and practices. Some Data Brokers may contact you for confirmation or to request additional information, and our ability to remove your information may depend on your timely response to them.
**4.5.4.** You may personally opt out of Data Brokers to the same extent that we can on your behalf. We make no claim that we have the ability to opt you out of any Data Broker beyond what you could accomplish yourself.
**4.5.5.** We are under no obligation to, and will not, pay any fees to a Data Broker to process an opt-out request.
**4.5.6.** You may authorize us to act only on your behalf, except as permitted under the Family Protection Plan for an underaged member. If you provide false, inaccurate, or unauthorized information, or information about another person without proper authority, we may suspend or terminate your access to the Services, and we reserve the right to report such conduct to law enforcement or other third parties and to cooperate in any related investigation.
**4.5.7.** We are not liable for the way any Data Broker treats or uses your personal information. A Data Broker’s treatment or use of your information will be subject to its own policies, if any, and not these Terms or the Privacy Policy of the Company.
**4.5.8.** While we will make reasonable efforts to remove your information, the effectiveness of the Services depends on the cooperation of the Data Brokers. We cannot and do not guarantee that the Services will be effective, that opt-out requests will be honored, or that all opt-outs will produce the same result. For example, some Data Brokers may remove all information submitted in an opt-out request, while others may remove only part or none at all. We are not responsible for the acts or omissions of any Data Broker and make no warranties, representations, or guarantees in this regard. You expressly agree that we will not be liable to you under any circumstances for any actions or inactions of the Data Brokers or for our failure, for any reason, to effectuate an opt-out on your behalf.
**4.6. Family Accounts**(s): The Services are not intended for individuals under the age of 18, except where included under a Family Account managed by a parent or legal guardian. By adding a family member under the age of 18 to a Family Account, the account owner represents and warrants that they are the child’s parent or legal guardian, have the legal authority to provide the child’s personal information, and consent to our collection and use of that information in accordance with these Terms and our Privacy Policy. We do not knowingly allow minors to create independent accounts, and any such accounts will be closed if identified.
